1.1 Spotprint, 178 The Gatehaus, Bradford, BD1 5BQ is incorporated and registered in England and Wales under company registration number 8762644 , (hereinafter referred to as "SpotPrint"). SpotPrint specialises in the production of printed materials such as, leaflets, brochures, postcards, posters and menus. SpotPrint also offers certain non-customised products for sale on its Website (as defined below) to its customers.

Please read these terms and conditions carefully before placing an order. By ordering any of SpotPrint's products, you agree to be bound by these terms and conditions. The following Terms and Conditions apply to all orders and supersede all others. Receipt of acknowledgement of order by you, constitutes your acceptance that our conditions are the only conditions that apply to the contract notwithstanding any purported terms put forward by you.

1.2 The contract between ourselves the Company and the Customer shall be governed by and construed in accordance with English Law.


2.1 Credit accounts can be offered following a full credit check by SpotPrint. Accounts are to be settled in full by the end of the month following the month stated on the invoice unless special settlement terms have been agreed in advance, by us in writing.

2.2 For non-account holders full payment is required prior to delivery.

2.3 Discounts are offered on the understanding that credit accounts are paid in full by the due date. We reserve the right to invoice an amount equal to such discounts to accounts that become overdue.

2.4 VAT is charged at the current rate on all orders. Should the VAT element of your order go unnoticed until after the bill has been paid then the customer is liable to pay the VAT in full.


3.1Goods will not be delivered on accounts that remain unpaid for 14 days or more after the due date. We reserve the right to charge interest at 5% above the Lloyds TSB base rate on all overdue accounts from the due date until payment is received in full. We can however pursue payment of overdue accounts at any time after the due date and shall be in addition to and without prejudice to any other rights we may have against you.

3.2 We reserve the right to charge you for any legal or collection charges when we use a third party or Court proceedings to obtain payment of an overdue account.


4.1 The risk in the goods will pass to the customer on delivery.

4.2 All goods, even if delivery has been made remain the property of SpotPrint until payment has been received in full

4.3 Until payment has been made in full the customer shall clearly mark the goods so as they may be easily identified as SpotPrint's products and retain the goods separately from other goods in trust for us. Any payment received by you for any sale of such goods must be held in a separate account in trust for us.

4.4 Should the customer default on payment for the goods SpotPrint will, without loss of any rights or remedy, recover the goods from your procession and shall be entitled to enter the property used to store the goods to repossess and remove the them. For the purposes stated you hereby grant us an irrevocable licence to enter your premises.


We reserve the right to adjust prices quoted to take into account any changes in the law or Government regulations requiring us to increase prices by way of direct taxation, import duties, customs and excise duties or other. Prices are based current costs of production and in the event of any increase in wages or materials costs occurring after acceptance of the contract, we shall be entitled to charge such increases to you.


All prices quoted are subject to VAT at the current rate where applicable.


7.1 Whilst we will make every effort to deliver on time, any specified delivery day is a best estimate and SpotPrint will accept no liability for any loss arising from delay or error in the delivery of the goods. All deliveries will be charged at the prevailing rates applying at the date of such delivery.

7.2 Special rush deliveries can be arranged but will be subject to additional charges for rush print and rush delivery

7.3 SpotPrint accepts no responsibility for deliveries being missed due to non payment. It is the customer's responsibility to ensure that full payment is made before delivery can take place.


We shall be deemed to have fulfilled our contract by delivery of a quantity within 5% plus or minus of the quantity of printed goods ordered and you will be charged at the contract rate for the quantity delivered.


We reserve the right to alter any details of advertised products without notice. Whilst we make every effort to describe goods accurately we give no warranty as to the accuracy of such description and accept no responsibility for error or inaccurate description of goods and any loss resulting.


10.1 All claims arising from damages, delay or partial loss in transit must be made in writing to reach us within 5 days of the delivery date.

10.2 All claims regarding the quality or quantity of the goods shall also be made in writing to reach us within 5 working days of receipt of goods or such goods shall be deemed to comply with the terms of the contract for quality and quantity.

10.3 All goods must be inspected at the time of delivery and any damage noted on the delivery note. SpotPrint will not be liable for any loss arising from damage caused to the goods during transit unless the loss or damage is noted on the delivery note at the time of delivery.

10.4 Claims in respect of non-delivery must be made in writing to reach us within 4 days of receipt of our invoice.

10.5 SpotPrint will require all printing to be returned in full before agreeing to reprint the order. Should SpotPrint deem the printing to be of sufficient quality, and within industry tolerance we reserve the right to return the goods and refuse to reprint or refund.


11.1 Unless defects in the goods cause death, injury or damage to personal property, SpotPrint's liability for loss or damage suffered by you in respect of the goods shall be limited to the contract value of the goods.

11.2 We accept no responsibility for loss or damage arising from the supply of goods under this contract unless you have fully complied with the claims procedure set out in clause 10.

11.3 These terms and conditions do not affect your Consumer Rights


12.1 We Reserve the right to rectify defective work by reprinting and will not be liable to refund.

12.2 If we offer to replace part or all of an order, unless you can show clear cause for refusing, you must accept such an offer

12.3 If you agree to have work re-done by a third party without our agreement then you automatically rescind your right to any remedy from us including refund.

12.4 Defective work must be returned to us before we will replace it. If you do not return the work we will assume that it has been accepted and will not provide a replacement.

12.5 Should SpotPrint agree to make a refund it will take 3 to 4 working days to complete and cannot be completed in less time due to banki ng procedures.


Cancelled orders will incur a 5% charge of the total value of the original order plus a £10.00 administration charge. We will also charge any costs we have incurred for work already carried out up to the date of written cancellation.


Samples will be submitted on approval and if not returned in good condition within 14 days we will charge to replace them in full.


Any changes to the ordered quantity must be made in writing prior to the start of SpotPrint processing the order. Should the written notification be received after work has started on the original order then the order will be considered as a separate contract.


The copyright on all printing plates, litho positives and negatives, artwork, designs, photographic transparencies, negatives or positives and any other artistic craftsmanship made by or for SpotPrint pursuant to or in implementation of any contract with the customer shall belong to SpotPrint. Unless the customer does defaults on payment SpotPrint promise not to reproduce any such items for any competitor of the customer.


Should approval to print not be received after 14 days an additional 5% charge of the total value of the original contract and a £10.00 administration fee will be made.


For work on hold we will charge an additional 5% charge of the total value of the original order plus £20.00 administration fee if we have not been notified within 14 days proceed


SpotPrint will not be held responsible for failure or delay in carrying out its obligations under the contract arising from any cause outside our reasonable control or by the inability to procure materials or articles except at higher prices due to any such cause. In such circumstances we shall be entitled to terminate the contract in whole or in part without incurring any liability whatsoever.


All goods should be checked on arrival as any complaints must be made within 48hours of receipt of your goods. Any complaints made after 48hours of receipt will be make any right to refund or reprint invalid.
